IT WILL BE NECESSARY FOR YOU TO AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BEFORE BEING PERMITTED TO CONTINUE TO INSTALL THE PRODUCT. IF YOU DO NOT ACCEPT THE TERMS OF THE LICENSE AGREEMENT THE INSTALLATION PROCESS WILL BE TERMINATED. YOU SHOULD PROMPTLY RETURN THE SOFTWARE PRODUCT FOR A REFUND OF THE AMOUNT PAID WITHIN THIRTY (30) DAYS OF THE DATE OF PURCHASE. VERY IMPORTANT - READ CAREFULLY: This Hillside Software License Agreement (hereinafter 'LICENSE') is a legal agreement between you and Hillside Software, Inc. ('Hillside') for the software associated with this package and for which Security Codes are obtained through Hillside or an authorized distributor. By installing or otherwise using the SOFTWARE, you agree to be bound by the terms of this LICENSE. If you do not agree to the terms of this LICENSE, promptly return the unused SOFTWARE within 30 days of purchase to the place from which you obtained it for a full refund. 1. Grant of License. Single User License: The software may be copied to no more than two CPU's and may only be accessed by the licensee for his or her personal use. Site License: The software may be used on all Company or Broker provided computers designated for shared use at a single address (site). These computers must be owned by the Company or Broker at that site. 2. Copyright. The software is owned by Hillside Software and is protected by United States copyright laws and international treaty provisions. You must therefore treat the software like any other copyrighted material except that you may make a copy of the software for backup or archival purposes. You may not copy the written materials accompanying the software. 3. Terms of License. The license will continue until you physically destroy all copies of the software and return the original diskettes and manuals to Hillside Software. 4. Other Restrictions. You may not rent or lease the software to others and you may not transfer the software. You may not reverse engineer, decompile, or disassemble the software. You agree to use the product in accordance with the rules and regulations of the local MLS. You agree to assume all responsibility for the use of this product by other individuals. 5. Limited Warranty. You assume all responsibility for the selection of the software as appropriate to achieve the results you intend. Hillside Software warrants that the enclosed diskette medium upon which the software is recorded shall be free from defects in material and workmanship under normal use and conditions, and that the software shall perform substantially as described in its documentation for a period of ninety days from date of purchase. EXCEPT FOR THE FOREGOING LIMITED WARRANTY, THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT WARRANTY OF ANY KIND EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. 6. Consequential Damages. In no event shall Hillside Software or its distributors be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of use of or inability to use this Hillside Software product, even if Hillside Software or its distributor has been advised of the possibility of such damages. 7. Disclaimer. There is no guarantee of the accuracy of the data obtained by the use of the software pursuant to this License Agreement, except that such data will be reasonably accurate. Data will be updated on a continuous and on-going basis. You assume all responsibility to access the database and update your accessed data in order to keep it current. Disclaimer: This Statement of Compliance refers to the Virtual Office, Version 5.3a or higher product as delivered by Hillside Software. The Compliance Statement does not apply to user customizable features or third party add-on features or products.
